Can an E-Visa be Converted into a Work Visa?

The answer is Yes.
Under the provisions of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam (2019), it is permissible to convert an Electronic Visa (e-Visa) into a Work Visa, provided that the applicant meets certain legal requirements — specifically, possessing a valid Work Permit or a Certificate of Work Permit Exemption, as prescribed by law.

If all eligibility conditions for conversion are met, the foreign national is not required to leave Vietnam to obtain the new Work Visa.

 

Conditions for Converting an e-Visa into a Work Visa

Pursuant to the amended Law on Entry, Exit, Transit, and Residence of Foreigners (2019), the conversion from an e-Visa to a Work Visa is allowed when the following conditions are satisfied:

·         The foreign national entered Vietnam with a valid e-Visa that has not yet expired.

·         The foreign national possesses a valid Work Permit or a valid Certificate of Work Permit Exemption, issued by the competent authority, and still within its validity period.

 

Validity Period of a Work Visa

There are two categories of Work Visas in Vietnam:

·         LĐ1 Visa (Work Visa Type 1): Granted to foreigners who are exempt from the requirement of a Work Permit (as stipulated in Decree No. 70/2023/NĐ-CP), but who must still obtain a written confirmation of exemption.

·         LĐ2 Visa (Work Visa Type 2): Granted to foreigners who are required to possess a valid Work Permit when working in Vietnam.

Both types of Work Visas have a maximum validity period of 12 months, depending on the duration of the corresponding permit or exemption document.

After obtaining a Work Visa, the foreigner may apply for a Temporary Residence Card (TRC). The Work-based TRC is valid for up to 2 years, consistent with the maximum duration permitted for the above two categories.
